Legal principle
A fair internal appeal can correct defects in the original dismissal process. The tribunal should consider the employer's disciplinary procedure as a whole and decide whether, viewed overall, the dismissal was fair.
What the court decided
The Court of Appeal rejected a rigid distinction between a rehearing and a review. The substance and fairness of the appeal matter more than the label placed on it.
The practical test

Identify defects in the original disciplinary decision.

Examine what evidence and arguments the appeal considered.

Decide whether the complete procedure produced a fair dismissal overall.
How tribunals apply it
- An appeal should engage with the employee's grounds rather than simply endorse the first decision.
- A sufficiently thorough appeal may repair an earlier procedural failing.
- A nominal or predetermined appeal is unlikely to cure a material defect.
