How your estimate is calculated

Your employment tribunal compensation estimate uses the dates, pay and other details you enter. Here is what goes into the figures and where the calculator makes assumptions.

  • Your basic award: this part uses your age, weekly pay and full years of service, up to 20 years. It applies the weekly-pay limit for your dismissal date. Age is estimated, so check the figures if a year of service crosses your 22nd or 41st birthday.
  • Income you have already lost: your take-home pay, pension contributions and benefits are worked out as weekly amounts. The estimate runs up to the date your new job starts, or today if you have not entered a new job.
  • Income you may lose in future: if you are still unemployed, the calculator allows for another 12 weeks of loss. If your new job pays less, it allows for 12 weeks of the difference in pay. This is a starting assumption; the right period for your case depends on your circumstances, evidence and efforts to find work.
  • Allowances and award limits: the estimate includes £500 for losing statutory employment rights. This is an assumed allowance, not a guaranteed payment. For ordinary unfair dismissal, the compensation for your losses is limited to the lower of the legal cap and 52 weeks of your pay before tax. Some types of claim have different limits or no cap.
  • Injury to feelings in discrimination claims: if you select a Vento band, the estimate adds the amount halfway between that band’s lower and upper figures. It uses the bands for the date you submit your tribunal claim, which may be different from your dismissal date. If you leave that date blank, it uses the current bands as an illustration. This is not a prediction of your award: the impact on you and the evidence matter.
  • Things that could change your final amount: the estimate does not automatically account for payments you have already received, tax, interest or reductions if your conduct contributed to the dismissal or the dismissal would have happened anyway. It also does not add an ACAS uplift automatically; you can assess that separately above.
