Legal principle
A final incident can revive earlier breaches and complete a cumulative breach of trust and confidence. The last straw need not itself be a fundamental breach, but it must contribute something to the cumulative conduct and cannot be wholly innocuous.
What the court decided
The Court of Appeal explained that an entirely trivial act cannot become a last straw simply because the employee subjectively treats it as one.
The practical test

Identify the earlier conduct capable of forming a cumulative breach.
- 2
Examine whether the final act added to or continued that course of conduct.
- 3
Ask whether the conduct viewed together amounted to a fundamental breach.
How tribunals apply it
- The last act does not need to be of the same type as the earlier conduct.
- An act that is entirely innocent and unrelated cannot supply the last straw.
- Delay after the final incident remains relevant to affirmation.
